This website is operated by madebyplasma ABN: 81859878240, a custom apparel decoration, live printing and retail business located at Burleigh Heads, Queensland, Australia. References to "we", "us" and "our" refer to madebyplasma. References to "you" and "your" refer to the person or business accessing this website or engaging our services.

By accessing this website or placing an order with us, you agree to be bound by these Terms and Conditions in full. If you do not agree, please do not use this website or our services.

2. Scope of Services

madebyplasma provides the following services:

• Custom screenprinting, embroidery, heat transfers, direct-to-garment printing, patches, woven labels and retail finishing
• Blank apparel, headwear and workwear sourcing from our wholesale supplier network
• Trade printing services for industry resellers, agencies and promotional suppliers
• Direct-to-consumer retail products via this website
• Live on-site printing and embroidery activations for events, festivals and retail activations

Different terms apply depending on the nature of your engagement with us. Please refer to the relevant Part of this document.

3. Website Use

You agree to use this website only for lawful purposes. You must not use this site to transmit any material that is unlawful, harmful, defamatory, offensive or that infringes the rights of any third party. We reserve the right to restrict or terminate access to this website at any time without notice.

4. Accuracy of Information

We make every effort to ensure the information on this website is accurate and current. However, we do not warrant that all content is complete, accurate or up to date. Material on this site is provided for general information only and should not be relied upon as the sole basis for decisions.

5. Third-Party Links

This website may contain links to third-party websites for convenience only. madebyplasma does not endorse, control or accept responsibility for the content, privacy practices or accuracy of any third-party site.

6. Privacy

The collection and use of your personal information is governed by our Privacy Policy, available on this website. By using our services, you consent to the collection and use of your information in accordance with that policy.

7. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Queensland.

PART B - CUSTOM PRODUCTION ORDERS

These terms apply to all custom-decorated apparel and merchandise orders placed directly with madebyplasma, including both trade and direct clients.

8. Quotes and Order Confirmation

All pricing is provided on a per-project basis following a formal quote. Quotes are valid for 14 days from the date of issue. After this period, pricing may be subject to change due to fluctuations in garment costs, ink prices, freight rates or supplier pricing.

An order is confirmed when you accept a written quote and pay the required deposit or full payment. madebyplasma reserves the right to decline any order at its discretion.

Any changes to quantities, garments, artwork or specifications after quote acceptance may result in revised pricing, which will be communicated to you before proceeding.

9. Payment

Full payment is required before production commences, unless otherwise agreed in writing. The remaining balance is due prior to dispatch or collection of completed goods.

All prices are in Australian Dollars (AUD) and exclude GST unless otherwise stated. GST will be added to invoices where applicable.

Overdue accounts may incur a late payment fee and suspension of services until the outstanding balance is settled.

10. Artwork Submission

You are responsible for submitting artwork that meets our production requirements. Artwork guidelines are available on this website.

Accepted file formats are vector files (.AI, .EPS, .PDF) or 300dpi raster files at actual print size. Artwork that requires resizing, clean-up or file preparation will incur a Design Prep Fee from $60 per hour plus GST.

By submitting artwork, you warrant that:

• You own or are fully licensed to use all elements of the submitted artwork
• The artwork does not infringe the intellectual property rights of any third party
• You have obtained all necessary permissions for logos, imagery, fonts and other elements

madebyplasma reserves the right to decline production of any artwork that, in our reasonable opinion, infringes third-party rights or is unlawful, offensive or inappropriate. You agree to indemnify madebyplasma against any intellectual property claims arising from client-supplied artwork.

11. Colour Matching

Pantone colour references must be supplied where accurate colour matching is required. If Pantone references are not provided, we will match as closely as possible but exact colour accuracy cannot be guaranteed.

Colours displayed on screen, in digital proofs or on printed references may vary from the finished result due to differences in ink type, fabric composition, garment colour and printing process. Screen-to-print colour variation within acceptable industry tolerances is not considered a production fault.

If colour accuracy is critical to your project, please advise us at the time of quoting. Physical strike-off samples can be arranged prior to full production on request and may incur additional charges.

12. Digital Proof Approval

A digital e-proof will be provided via email and SMS for your approval before production commences. Production does not begin until written approval is received.

By approving the e-proof, you confirm that all details are correct — including artwork, placement, colours, sizing, spelling, garment selection and any labelling or finishing requirements.

madebyplasma accepts no responsibility for errors present in an approved e-proof. Changes cannot be made after approval. If an error is identified after approval but before production commences, contact us immediately and we will assess whether changes are possible at that stage.

13. Industry Spoilage

An industry-standard spoilage allowance of 2–5% applies to all custom decoration orders. This means a small number of garments may be affected during production due to the nature of the decoration process. This is standard practice across the industry and does not constitute a production fault.

14. Production Turnaround

• Standard production: 7–10 business days
• Rush production: 2–3 business days (+25% surcharge)
• Ultra Rush: 1 business day (+50% surcharge, subject to approval and capacity)

Turnaround commences after payment clears and the e-proof is approved — whichever occurs last. Shipping time is additional to production turnaround.

madebyplasma will not be liable for delays caused by circumstances outside our control, including supplier delays, freight carrier delays or events of force majeure.

15. Additional Charges

The following additional fees may apply depending on the nature of your order:

• Specialty inks (puff, metallic, discharge, glow and others): additional charges apply
• Oversize or custom placements: additional setup and print fees
• Relabelling and rebagging: quoted per job
• Sampling: charged at full rate unless otherwise pre-arranged

16. Garment Sourcing and Availability

Where we source garments on your behalf, we do so through our network of trusted wholesale suppliers. Garments are subject to availability at the time of order confirmation. If a specified garment becomes unavailable, we will contact you to confirm a suitable alternative before proceeding.

Garment colours, sizing specifications and fabric composition may vary slightly between production batches. madebyplasma will advise you if a significant variation is identified.

17. Cancellations and Changes

Orders cancelled before e-proof approval may incur setup and artwork preparation fees already incurred. Orders cancelled after e-proof approval but before production commences will be charged for all setup and processing costs. Orders cancelled after production has commenced will be charged in full for all work completed to that point.

Changes to an order after e-proof approval may not be possible and, where accommodated, may result in additional charges and extended turnaround times.

18. Defective Goods

If you believe your order contains a production defect, you must notify us in writing within 48 hours of receiving the goods, providing photographic evidence and a description of the issue.

Where a production fault is confirmed by madebyplasma, we will at our discretion either reprint the affected items or issue a credit. Refunds are not provided where a reprint is offered and is consistent with the original order specifications.

Defects arising from client-supplied artwork errors, approved e-proof errors, incorrect information provided by the client or normal industry variation in decoration processes are not considered production faults. madebyplasma does not replace or reimburse misprints on client-supplied garments where the proof was approved.

19. Shipping and Split Shipments

Freight is charged at cost unless otherwise arranged. Risk of loss or damage passes to you upon handover to the carrier.

Split shipments — where one order is divided into two or more separate deliveries — can be accommodated on request. Each additional shipment will incur a handling fee and additional freight charges based on the number of shipments and delivery addresses. We will always communicate these costs before processing a split shipment. Splitting an order may extend overall production and fulfilment times.

PART C - TRADE PRINTING

These terms apply specifically to resellers, screen printers, embroidery operators, promotional suppliers, designers and agencies engaging madebyplasma on a trade basis.

20. Trade Eligibility

Trade pricing is exclusively available to industry resellers and is not available to end-users. Proof of industry involvement may be required, including ABN, website, portfolio or references. madebyplasma reserves the right to refuse or revoke trade status at its discretion.

21. Supplying Garments

When supplying custom garments not ordered through us or our approved local vendors (including AS Colour, Gildan and Colourplane), please include five extra garments per order for dye migration testing, defibrillation testing and shrinkage and wash testing. This ensures optimal results and minimises production risks.

All garments must arrive sorted by size, colour, style and design, with each job clearly packed and labelled separately. If garments arrive unsorted or unlabelled, a Sorting Fee of $40 per hour applies with a minimum charge of one hour.

22. Local Supplier Policy

All garments from local suppliers — including AS Colour, Gildan and others — must be ordered through madebyplasma, even if you hold your own account with that supplier. This ensures consistent wholesale pricing, consolidates delivery and aligns garments with your order number for accurate processing.

23. Trade Payment Terms

Full prepayment is required before production commences on all trade orders unless a trade account with agreed terms has been established in writing.

24. Confidentiality

All trade work is treated as strictly confidential. madebyplasma will not contact your clients directly or use their branding, artwork or identifying information for promotional purposes without your explicit written consent.

Shop tours, social media posts and portfolio content will exclude identifying trade client information unless approval has been provided in advance.

PART D — ONLINE STORE AND RETAIL ORDERS

These terms apply to direct-to-consumer purchases made through the madebyplasma online store.

25. Placing an Order

By placing an order through our online store, you confirm that you are authorised to use the payment method provided and that the information you have submitted is accurate and complete.

Order confirmation is sent via email upon successful payment. madebyplasma reserves the right to cancel any order prior to dispatch, including where a pricing error has occurred, where stock is unavailable or where we are unable to fulfil the order. You will be notified and a full refund issued if an order is cancelled by us.

26. Pricing and GST

All prices displayed in the online store are in Australian Dollars (AUD). Prices include GST unless otherwise stated. Prices are subject to change without notice. The price charged will be the price confirmed at the time of checkout.

Promotional pricing and discount codes are subject to the conditions stated at the time of the promotion and cannot be applied retrospectively.

27. Dispatch and Delivery

Stocked items are dispatched within 2–5 business days of payment confirmation unless otherwise stated on the product page. Delivery timeframes are estimates only and are subject to the carrier's schedule.

Shipping costs are calculated at checkout based on your delivery address and selected shipping method. Risk of loss or damage passes to you upon handover to the carrier.

madebyplasma delivers Australia-wide. International shipping may be available for select products and will be displayed at checkout where applicable.

28. Returns and Refunds — Retail

We want you to be satisfied with your purchase. If you receive a product that is faulty, damaged in transit or not as described, please contact us within 7 days of receipt with photographic evidence. We will arrange a replacement, exchange or refund as appropriate in accordance with the Australian Consumer Law.

Change of mind returns are accepted within 14 days of receipt provided the item is unused, unworn, in its original condition and original packaging. Return freight costs for change of mind returns are the responsibility of the customer. We reserve the right to decline a return that does not meet these conditions.

Custom-decorated or personalised items are not eligible for return or exchange unless they are faulty or do not comply with a consumer guarantee under the Australian Consumer Law.

PART E - LIVE EVENTS AND ACTIVATIONS

These terms apply to all live on-site printing, embroidery and garment customisation services.

29. Booking Confirmation

Live event bookings are confirmed upon payment of a deposit and written confirmation from madebyplasma. The deposit amount will be specified in your quote.

30. Client Responsibilities

You are responsible for providing adequate space, power access where required, appropriate lighting, site induction information and any venue-specific access requirements. These must be communicated to us no later than 7 days prior to the event date.

31. Cancellation by Client

Cancellations made more than 14 days prior to the event date will forfeit the deposit paid. Cancellations made within 14 days of the event will be invoiced at the full quoted amount.

32. Cancellation by madebyplasma

In the event that we are unable to attend due to circumstances outside our control — including equipment failure, illness or force majeure — we will notify you as soon as practicable and work to arrange an alternative date or provide a refund of monies paid for the affected services.

33. Event Conditions

madebyplasma reserves the right to cease operations at an event if conditions are unsafe, the venue requirements are not met by the client, or if the environment is inappropriate for production. In such circumstances, no refund will be issued for time and setup already incurred.

PART F - INTELLECTUAL PROPERTY AND LEGAL

34. Intellectual Property — madebyplasma

All content on the madebyplasma website, including text, images, logos, graphics and design, is the property of madebyplasma or its licensors and is protected by Australian copyright law. You may not reproduce, distribute or use any content without our express written permission.

35. Portfolio and Marketing Use

madebyplasma retains the right to photograph and use images of completed production work for portfolio, website and marketing purposes, unless you notify us in writing prior to production that you do not consent to this use. Trade client work is subject to the confidentiality terms in Part C.

36. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee, warranty or condition implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.

Where the Australian Consumer Law permits us to limit our liability, our liability is limited to, at our option: the resupply of the relevant services or goods, or payment of the cost of having the services or goods resupplied.

37. Limitation of Liability

To the maximum extent permitted by law, madebyplasma's total liability to you for any claim arising from or related to these Terms or our services is limited to the amount paid by you for the specific order or booking to which the claim relates.

madebyplasma is not liable for any indirect, consequential, incidental, special or punitive damages, including loss of profits, loss of revenue, loss of data or loss of business opportunity, even if advised of the possibility of such damages.

38. Indemnification

You agree to indemnify, defend and hold harmless madebyplasma and its officers, employees, contractors and suppliers from any claim, loss, damage or expense — including reasonable legal costs — arising from your breach of these Terms, your submitted artwork, or your violation of any applicable law or third-party rights.

39. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforceable to the fullest extent permitted by law and the remainder of these Terms will continue in full force and effect.

40. Changes to These Terms

We may update these Terms and Conditions at any time by posting the revised version on this website with an updated date. Your continued use of this website or our services after changes are posted constitutes your acceptance of the updated Terms.
